Will my bank negotiate with me so that I can avoid foreclosure?
In some cases, your lender may modify the loan if you have an adjustable
mortgage rate. It would not hurt to speak with your lender's loan modification
department.
The lender may:
- Accept partial payments
- Accept a late payment
- Agree to modify your loan
Can I sell my home for a lower amount than what I owe on my mortgage?
You will need to negotiate with and get permission from your lender for
a short sale. A short sale is when you sell your house for an amount that
is lower than what you owe the lender. Your lender does not have to release
its lien on your home until the mortgage is fully paid.
Can bankruptcy stop my foreclosure?
The bankruptcy process can delay a foreclosure, but it will not stop it
permanently. When you file for bankruptcy, the court will issue an "automatic
stay." It will direct creditors to cease all collection and foreclosure
actions. The sale will be postponed, which will allow you time to work
out a resolution.
Are there foreclosure protections for military personnel?
To protect military personnel, mortgage lenders are restricted from foreclosing
on a home that is owned by a military member who is on active duty. The
lender, however, can seek special permission from the court to bypass
this restriction.
